Terms and Conditions of Winly Services
This agreement outlines the mutual rights and obligations of "Winly" and "Users". Registration and use of Winly services constitute careful reading and acceptance of all provisions of this document.

Definitions and Terminology
In this agreement, the following terms are used with the described meanings:
- Winly: The brand name of the web-based software platform that provides online lottery services, social media data analysis, and gamification tools.
- User: Any natural or legal person who registers on the Winly system and uses its services.
- User Account: The user's dedicated panel provided after registration and authentication for managing services and payments.
- Service: All software services provided by Winly, including comment extraction, random lottery, interaction analysis, and other tools.
- Social Networks: Third-party platforms such as Instagram, YouTube, Telegram, etc., on which Winly provides analytical services.
General Conditions and Acceptance of Rules
2.1. All Winly principles and procedures are in accordance with the laws of the Islamic Republic of Iran, the Electronic Commerce Law, and the Consumer Rights Protection Law.
2.2. By registering with Winly, the user confirms that they have read these rules and accepted all conditions without any reservation. The user's lack of knowledge of the rules will not relieve them of their responsibilities.
2.3. Use of Winly services for individuals under 18 is only allowed under the supervision of parents or legal guardians. Winly is not responsible for the accuracy of users' age information.
2.4. Winly reserves the right to change parts of the rules at any time without prior notice. Continued use of the service by the user constitutes acceptance of the new rules. The latest version of the rules is always available on this page.
User Account and Security
3.1. The user is responsible for maintaining the confidentiality of their username and password. All activities performed under the user account are the user's responsibility.
3.2. The user undertakes to enter their correct and real information during registration. In case of using fake information or information belonging to others, Winly has the right to block the account.
3.3. Each user (natural or legal person) is only allowed to have one user account. Creating multiple accounts to abuse free plans or discounts is prohibited.
3.4. The user does not have the right to transfer, sell, or rent their user account to third parties.
Intellectual Property Rights
4.1. All contents of the Winly website, including texts, graphics, logos, icons, images, videos, software codes, and brand names, are considered Winly's intellectual property and are protected by copyright laws.
4.2. Any data scraping, reverse engineering, copying, or commercial use of Winly services without written permission is prohibited and subject to legal prosecution.
4.3. By uploading content (such as a logo or contest banner) to Winly, the user grants Winly a non-exclusive and free license to display it on the platform. The intellectual property of this content remains with the user.
User Obligations and Responsibilities
Important Note:
Winly bears no responsibility for the content of contests, prizes, and how users conduct lotteries.
5.1. The user is committed to using Winly services for legal purposes. Conducting any lottery or contest that contradicts the laws of the Islamic Republic of Iran (such as betting, gambling, criminal content, etc.) is strictly prohibited.
5.2. The user is obliged to comply with the rules and regulations of reference platforms (such as Instagram or YouTube terms of use). Winly is not responsible for the closure of a person's user account on social networks due to violation of their rules.
5.3. The user is committed to delivering the promised prizes in their contests to the winners. Winly is only a tool for selecting the winner and has no obligation regarding prize delivery.
5.4. Any attempt to manipulate lottery results, penetrate the system, or disrupt server operations will result in permanent account blocking and legal prosecution.
Payments and Refunds
6.1. All payments in Winly are made through valid and official banking gateways of the country.
6.2. Refund Policy: Due to the nature of digital and consumable services (such as data processing), refunds are not possible after purchasing a subscription or credit, except in cases where a technical failure from Winly has prevented service provision.
6.3. In case of a technical error resulting in deduction from the user's account without credit application, the deducted amount will be returned to the user's account by the bank within 72 working hours.
6.4. Changing tariffs is Winly's reserved right, and new tariffs will apply to new purchases after publication on the site.
Disclaimer and Limitations
7.1. Winly services are provided on an "AS IS" basis. Winly does not guarantee that the services will be error-free, uninterrupted, or completely secure, although it makes every effort to maintain service stability.
7.2. Due to reliance on APIs and access to third-party platforms (such as Instagram), Winly gives no guarantee regarding permanent access to data from these platforms. If Instagram's policies change or access is restricted, Winly will not be responsible.
7.3. Winly is not responsible for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the service, loss of data, or business interruption of the user.
Privacy and Security
8.1. Winly is committed to protecting user privacy and will not provide personal information (phone number, email) to third parties without a legal warrant.
8.2. Winly uses standard security protocols (SSL) for data transmission but does not guarantee complete security on the internet.
8.3. Information related to lotteries (such as the list of participants) is stored on Winly servers for a limited time only and may be deleted thereafter.
Dispute Resolution and Governing Law
9.1. This agreement is subject to the laws of the Islamic Republic of Iran.
9.2. In case of any dispute, the parties will try to resolve the issue through negotiation and support. If no result is achieved, the most competent judicial authority in Tehran will have jurisdiction to handle the case.
Changes and Force Majeure
10.1. Winly is not responsible for failure to perform its obligations due to force majeure events (such as nationwide internet outages, natural disasters, war, sanctions, etc.).
10.2. Winly has the right to stop providing part or all of its services at any time. In case of permanent cessation, the remaining credit of users will be refunded.
This document was updated on December 22, 2024 and replaces all previous agreements.
